Art. 1. Scope of Application
1.1. These Terms of Use govern access and browsing on the DineIT website and/or mobile application (the “Platform”) by any user, including unregistered ones (the “User”).
1.2. Access, consultation and use of the Platform imply acceptance of these Terms of Use.
1.3. Additional contractual conditions applicable to registered users and participating restaurants remain in force.
Art. 2. Nature of the Free Access Service
2.1. Free access to the Platform allows exclusively the consultation of informational content, including:
- list of participating restaurants;
- description of available offers and promotions;
- editorial content, images and general information about the Service.
2.2. The User acknowledges that:
- discounts, offers or benefits are reserved for registered users and, where applicable, subscription or voucher holders;
- browsing does not constitute any contract with DineIT.
Art. 3. User Obligations
3.1. The User undertakes to use the Platform in compliance with the law, these Terms of Use and principles of fairness and good faith.
3.2. The User is prohibited from:
- using the Platform for illegal or fraudulent purposes;
- interfering with the operation of the Platform or attempting unauthorized access;
- performing scraping, crawling or systematic data extraction without authorization;
- copying, reproducing or using Platform content for commercial purposes without DineIT's consent.
Art. 4. Intellectual Property
4.1. All Platform content, including texts, images, trademarks, logos, graphic layouts and software, are the property of DineIT or their respective rights holders and are protected by applicable intellectual property legislation.
4.2. Any unauthorized reproduction, distribution, modification or use of the content is prohibited.
Art. 5. Limitation of Liability
5.1. DineIT strives to keep the information on the Platform up to date but does not guarantee the absence of errors, omissions or inaccuracies.
5.2. DineIT is not responsible for:
- any decisions made by the User based on the information consulted;
- malfunctions, interruptions or unavailability of the Platform;
- content related to partner restaurants, which remain responsible for the information provided.
5.3. Access to the Platform is under the User's exclusive responsibility.
Art. 6. Links to Third-Party Sites
6.1. The Platform may contain links to third-party websites or services.
6.2. DineIT does not exercise any control over such sites and is not responsible for their content, services or policies.
Art. 7. Amendments
7.1. DineIT reserves the right to modify these Terms of Use at any time.
7.2. Amendments shall be effective from the time of their publication on the Platform.
Art. 8. Applicable Law and Jurisdiction
8.1. These Terms of Use are governed by Italian law.
8.2. For any dispute related to the interpretation or application thereof, the court of the User's place of residence or domicile is competent if a consumer, or otherwise the court of Rome.
